Making Sure Notaries Get Paid

To all of my fellow notaries,

         I wanted to put a couple of inserts to make a point about the responsibility of the SETTLEMENT/ESCROW/TITLE /LOAN OFFICERS paying late or not paying at all, let’ talk about it. Be well aware that it is solely the responsibility of the SETTLEMENT/ESCROW/TITLE /LOAN OFFICER to make sure you ( notary closing agent) is paid on time. This would be upon disbursement or settlement of all fees. If you are not paid within this time this frame I would send a nice email over to the company that owes me the money the first time and if I don’t get a decent response within that time frame  I will send out another email A reference to my payment. At this time if they have not responded properly you would probably want to threaten to report them to the BBB for breach of contract and send them word for word what their contract states about paying a notary On your third correspondence. This usually get results. 

            The reason why I’m mentioning this is Lately there have been many signing services that have been paying late or have not been paying at all claiming they cannot find the files or there must have been an oversight. The Royal few who have been folding up, or holding payments far beyond after disbursements has been done. You have some signing services who employ PONZI model of payment, by waiting on payments from future transactions to pay notaries as late as 45 days/60 days and beyond. In cases like these, credit terms for notary payment are never allowed & the above mentioned people will be held responsible for non-payment/default and other civil liabilities. In any case all notaries must be paid for work done, irrespective of whether transaction consummate or not. Please ensure that the signing service pay the notaries promptly & that they have the financial stability to do so.

          There are some signing services that continue to thrive on deception by changing business entity names and restarting this deception. Be on the lookout for those type of companies. There is currently lack of compliance and checks on signing services And which needs to Looked into more closely.
